College of Pharmacists of BC wins appeal in incentives case!

The College is pleased to announce that the BC Court of Appeal released its decision today on the bylaws prohibiting the provision of incentives for prescriptions or pharmacy services.

The BC Court of Appeal ruled unanimously in favour of the College of Pharmacists of BC, which means that the bylaws are now in force.

Honorable Madam Justice Newbury's decision states "The College can prohibit incentive programs ... inducements from pharmacists [are] a matter of public interest and professional standards." Read the full decision on the BC Courts website. 

This decision overturns the BC Supreme Court decision that was released on July 25, 2015. 

The BC Court of Appeal decision is a significant milestone for a self-governing profession and a major achievement since the College first put forth the bylaws on December 2, 2013. 

The bylaws prohibiting the provision of incentives for prescriptions or pharmacy services are found under the Health Professions Act Bylaws - Schedule F - Part I Community Pharmacy Standards of Practice and the Pharmacy Operations and Drug Scheduling Act Bylaws.
